Completed tenders in sealed tender envelopes marked “Fuel List 2010’’ must be returned to Corporate Services Department, South Dublin County Council, County Hall, Town Centre, Tallaght, Dublin 24 not later than 4:00 p.m. on Wednesday, 4.11.2009. Late tenders will be returned and not considered.
It is a condition for the award of the contract that the successful tenderer and all sub-contractors produce a Valid Tax Clearance Certificate or C2 Certificate from the Revenue Commissioners. In the case of a non-resident tenderer, a statement of suitability on tax grounds from the Revenue Commissioners in Ireland will be required.
The lowest or any tender will not necessarily be accepted.
South Dublin County Council is subject to the provisions of The Freedom of Information (FOI) Act, 1997 and 2003. If you consider that any of the information supplied by you is either commercially sensitive or confidential in nature, this should be highlighted and the reasons for its sensitivity specified. In such cases, the relevant material will, in response to FOI requests be examined in the light of the exemptions provided for in the FOI Act.
The Prompt Payment of Accounts Act, 1997, will also apply to these contracts.

1.Definition
The tenderer should retain the Specifications for their own future reference. Do not return the Specifications with your tender. Return, as your tender, only the Schedule of Rates Charts and the Proposals & Agreement Form and any other information required.
Important notice to tenderers.
1. Fuel oils shall be delivered to South Dublin County Council, depots and offices throughout the County. Approximate annual requirements at each of the locations, as well as the tank capacities at each location, are given in the attached Schedule of Rates. However, while these requirements have been worked out carefully, they are by no means definite. There may be lower or higher requirements at the locations, depending on circumstances, as well as the possibility of other requirements at depots not mentioned in the Schedule.
2. You must fill in the information required at the bottom of Page 3 and Page 4 of the Schedule of Rates Charts. State (by ticking the appropriate line) which of the physical requirements (a) or (b) your Winter Grade Diesel conforms with.
3. The General Conditions of Contract allows your tender in the case of Petroleum Fuel Products to be subject to price variation during the twelve month tender period. However, you must also state in writing, with your tender, how such price increases will be calculated - otherwise your prices will be deemed to be fixed for the twelve month period. No price increases will be allowed in the case of oils and grease (Spec. Nos. R19-4 and R19-5).
4. Where the materials for which you submit a tender are covered by a recognised certification scheme (e.g. Irish Standard Certification Scheme administered by Eolas, Kitemark Scheme administered by B.S.I., etc.), you should submit with your tender details of such certification, clearly indicating what item of material it refers to. Where no such evidence is submitted with your tender, it will be assumed that your materials are not covered by such a certification scheme.
5. Nothing stated in this Specification is to be construed as discriminating against products and materials manufactured in any of the Member States of the European Community. Where items to an Irish Standard Specification, A British Standard Specification, or any other standard specification of a Member State of the European Community are called for, this requirement shall be read as including items to a relevant international standard, or the relevant national standard of any Member State of the European Community which provides an equivalent guarantee of safety and suitability. Where items certified by the National Standards Authority of Ireland as complying with an Irish Standard are called for, the provisions of Circular Letter BM2/87 shall apply, i.e. the requirement shall be read as either certified by the National Standards Authority of Ireland as complying with the Irish Standard, or shall be certified as complying with a relevant international standard, or with the relevant national standard of another Member State of the European Community, which provides an equivalent guarantee of safety and suitability.
6. Deliveries of white diesel (Class A1) and green diesel (Class A2) shall be metered, and a printed delivery docket submitted to the County Council’s receiving official/storeman.
7. 'Split' deliveries, or 'splitting' compartments is not acceptable to the County Council. Tenderers should submit with their tender details of the compartment capacities of tankers to enable the County Council to issue orders compatible with the compartment capacities of the successful tenderer(s).
8. The attention of Tenderers is especially drawn to their obligations under the Dangerous Substances (Retail and Private Petroleum Stores) S.I. 311/1979 and S.I. 313/1979 (Bulk Petroleum Stores) Regulations.

Specification R19-1This material shall conform in all respects with the Petrol requirements of BS 7800 Unleaded Petrol (Gasoline) for motor vehicles.
The tenderer shall tender for one grade of petrol as follows:
Premium (4 star) having minimum RON of 97.0.
(RON - Research Octane Number).
Specification R19-2This material shall conform in all respects with the.
White Diesel requirements of BS 2969 Part 1 (1988) Fuel Oils for.
(Class A1) non-marine use: Automotive Diesel Fuel except where the.
Following requirements differ from that standard.
It shall be Class A1 engine fuel as detailed in Table 1 of BS 2869 Part 1 (1988) and is intended primarily as an automotive diesel fuel mainly for use on the public highway.
It shall be Winter Grade conforming with the requirements of IS 251 (1981) Winter Grade Diesel and Heating Oil. It should be noted that IS 241 (1981) requires a cold filter plugging point of not above - 12°C or a cloud point of not above - 7°C. The tenderer shall state on Page 2 of the Schedule of Rates Charts which one of these criteria his Winter Grade Diesel conforms with. Any other options with lower cloud points shall also be quoted for.
Specification R19-3 This material shall conform in all respects with the.
Gas Oil requirements of BS 2869 Part 1988 Fuel Oils for non-.
Green Diesel marine use: Oils for agricultural and.
(Class A2) industrial engines and burners except where the following requirements differ from the standard.
It shall be Class A2 engine and burner fuel as detailed in Table 1 of BS 2869 Part 2 (1988) and is intended as a general purpose diesel fuel. It shall contain a green dye additive.
It shall be Winter Grade conforming with the requirements of IS 251 (1981) Winter Grade Diesel Oil. It should be noted that IS (1987) requires a cold filter plugging point of not above - 12°C (Amd. No. 1 1987) and a cloud point of not above 0°C or a cloud point of not above - 7°C. The tenderer shall state on Page 3 of the schedule of Rates Charts which one of these criteria his Winter Grade Diesel conforms with.
Specification R19-4 This shall be engine oil, gear oil and hydraulic oil of the.
